1. General Provisions

This Privacy Policy has been prepared in accordance with the General Data Protection Regulation of the European Union (GDPR).

1.1. The Controller regards respect for the rights and freedoms of natural persons in the processing of their personal data — including the protection of privacy and personal and family confidentiality — as the primary aim and precondition of its activity.

1.2. This Personal Data Processing Policy (the “Policy”) applies to all information that the Controller may obtain about visitors through the website https://nexus-fidei.de.

2. Terms Used in This Policy

2.1. Automated processing of personal data — processing of personal data using computer technology.

2.2. Blocking of personal data — temporary suspension of processing (except where processing is necessary to clarify the data).

2.3. Website — the collection of graphic and informational materials as well as computer programs and databases available on the internet at https://nexus-fidei.de.

2.7. Controller — a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data.

2.8. Personal data — any information relating to a directly or indirectly identified or identifiable user of the website https://nexus-fidei.de.

2.9. Personal data authorized for dissemination — personal data to which an unlimited number of persons have access on the basis of the data subject’s consent and whose dissemination the data subject has permitted in accordance with applicable rules.

2.10. User — any visitor to the website https://nexus-fidei.de.

3. Rights and Obligations of the Controller

3.1. The Controller is entitled to:

  • receive accurate information and/or documents containing personal data from the data subject;
  • continue processing after withdrawal of consent, where a legal basis exists;
  • independently determine the scope and selection of measures necessary to fulfil its legal obligations, unless otherwise provided.

3.2. The Controller is obliged to:

  • provide the data subject, upon request, with information about the processing of their data;
  • organize the processing in accordance with the applicable law of the European Union;
  • respond to requests from data subjects and their legal representatives in accordance with the GDPR;
  • provide the competent supervisory authority, upon request, with the necessary information within 30 days;
  • publish or otherwise make this Policy available;
  • take legal, organizational and technical measures to protect personal data against unauthorized or accidental access, destruction, alteration, blocking, copying, disclosure or dissemination;
  • cease transmission and processing and destroy data in the cases provided by law;
  • fulfil other obligations provided by law.

4. Rights and Obligations of Data Subjects

4.1. Data subjects have the right to:

  • receive information about the processing of their personal data, as permitted by law;
  • request the correction, blocking or deletion of their data where it is incomplete, outdated, inaccurate, unlawfully obtained or not necessary for the stated purpose;
  • require prior consent for processing for marketing purposes;
  • withdraw their consent to processing;
  • lodge a complaint with the competent supervisory authority or seek judicial remedy;
  • exercise other rights provided under the law of the European Union.

4.2. Data subjects are obliged to:

  • provide the Controller with accurate information about themselves;
  • inform the Controller of any correction (update, change) of their data.

4.3. Persons who have provided the Controller with inaccurate information about themselves or about a third party without that party’s consent are liable in accordance with EU law.

5. Personal Data Processed

The Controller may process the following personal data of the user:

  • surname, first name;
  • email address;
  • telephone number.

5.4. In addition, anonymized data about visitors (including cookies) is collected and processed on the website using internet analytics services.

5.5. The above data is hereinafter referred to collectively as “personal data”.

5.6. The Controller does not process special categories of personal data concerning racial or ethnic origin, political opinions, religious or philosophical beliefs, or private life.

6. Principles of Data Processing

6.1. Personal data is processed lawfully and fairly.

6.2. Processing is limited to achieving specific, predetermined and lawful purposes. Processing incompatible with those purposes is not permitted.

6.3. The merging of databases processed for incompatible purposes is prohibited.

6.4. Only personal data that corresponds to the purposes of its processing is processed.

6.5. The content and scope of the processed data correspond to the stated purposes; any processing beyond this is prohibited.

6.6. During processing, the accuracy, completeness and, where necessary, the timeliness of the data is ensured. The Controller takes the necessary measures to delete or correct incomplete or inaccurate data.

6.7. Personal data is stored in a form that allows identification of the data subject for no longer than necessary for the purposes of processing. After the purposes are achieved, the data is destroyed or anonymized, unless otherwise provided by law.

7. Purposes of Data Processing

7.1. Purposes of processing the user’s personal data:

  • informing the user by sending emails;
  • conclusion, performance and termination of civil-law contracts;
  • providing the user with access to services, information and/or materials on the website https://nexus-fidei-law.com.

7.2. The Controller is also entitled to send the user notifications about new products and services, special offers and events. The user may opt out of such notifications at any time by sending an email to info@nexus-fidei.de with the subject “Unsubscribe from notifications”.

7.3. Anonymized data collected through internet statistics services is used to record user activity on the website and to improve the website and its content.

8. Legal Basis for Processing

8.1. The legal basis for processing is:

  • contracts concluded between the Controller and the data subject;
  • the applicable law of the European Union;
  • laws and other regulations in the field of data protection;
  • the user’s consent to the processing of their personal data.

8.2. The Controller processes the user’s personal data only if it has been entered and/or submitted by the user via the forms on the website https://nexus-fidei-law.com or sent to the Controller by email. By completing the forms and/or submitting their data, the user consents to this Policy.

8.3. The Controller processes anonymized data about the user provided this is permitted in the user’s browser settings (storage of cookies and use of JavaScript enabled).

8.4. The data subject decides independently to provide their personal data and gives consent voluntarily.

9. Conditions of Processing

9.1. Processing is carried out with the consent of the data subject.

9.2. Processing is necessary to achieve the purposes provided for by an international treaty of the EU or by law.

9.3. Processing is necessary for the administration of justice and the enforcement of judicial or administrative decisions.

9.4. Processing is necessary for the performance of a contract to which the data subject is a party, beneficiary or guarantor, or to conclude a contract at the data subject’s initiative.

9.5. Processing is necessary to protect the rights and legitimate interests of the Controller or third parties, provided the rights and freedoms of the data subject are not violated.

9.6. Personal data to which, at the data subject’s request, access has been granted to an unlimited number of persons is processed.

10. Collection, Storage, Transfer and Other Processing

The security of the processed data is ensured by legal, organizational and technical measures necessary for full compliance with applicable data protection law.

10.1. The Controller ensures the security of the data and takes all possible measures to prevent unauthorized access.

10.2. The user’s personal data will not be disclosed to third parties except in cases related to compliance with applicable law, or where the data subject has consented to such disclosure.

10.3. In case of inaccuracies, the user may update their data independently or send a notification to support@nexus-fidei.com with the subject “Update of personal data”.

10.4. The processing period is determined by the achievement of the purposes for which the data was collected, unless another period is provided by contract or law. The user may withdraw consent at any time by sending an email to support@nexus-fidei.com with the subject “Withdrawal of consent”.

10.5. All information collected by third-party providers (including payment systems and communication services) is stored and processed by them in accordance with their own terms and privacy policies. The Controller is not liable for the actions of such third parties.

10.6. The Controller ensures the confidentiality of the data during processing.

10.7. Processing may be terminated upon achievement of the purposes, expiry of consent, its withdrawal, or upon detection of unlawful processing.

11. Actions Performed by the Controller

11.1. The Controller collects, records, systematizes, stores, updates, processes, uses, transfers, anonymizes, blocks, deletes and destroys personal data.

11.2. The Controller carries out automated processing in which information is collected and/or transmitted via information and telecommunications networks or without them.

12. Cross-Border Transfer

12.1. Before any cross-border transfer, the Controller ensures that the destination state provides an adequate level of protection of the rights of data subjects.

12.2. Transfer to states without an adequate level of protection is carried out only with the written consent of the data subject and/or for the performance of a contract to which the data subject is a party.

13. Confidentiality of Personal Data

The Controller and other persons with access to personal data are obliged not to disclose or transfer it to third parties without the consent of the data subject, unless otherwise provided by law.

14. Final Provisions

14.2. This document contains all changes to the Policy. The Policy remains in force indefinitely until replaced by a new version.
