These Terms and Conditions (“Terms”) apply to all contracts and services between Nexus Fidei Legal Services Ltd (30 Crown Place, Earl Street, EC2A 4EB London, United Kingdom) and Nexus Fidei Legal Services GmbH (Talacker 41, 8001 Zurich, Switzerland) — hereinafter jointly the “Provider” or “we” — and our clients (“Client”).
1.1. These Terms apply to all contractual relationships initiated and concluded via the website https://nexus-fidei-law.com
1.2. Deviating conditions of the Client are not recognized unless we expressly agree to them in text form.
2.1. The subject of our services is assistance in the recovery of assets removed through fraud or unlawful acts.
2.2. The specific scope of services arises from the individual engagement agreement between the Provider and the Client.
2.3. We owe diligent work within the agreed engagement but no specific outcome, unless expressly agreed otherwise. The chances of success depend on the individual case, the available evidence and the relevant jurisdiction.
3.1. A contract is formed by the mutual signing of an engagement agreement or by express order confirmation in text form.
3.2. The non-binding initial assessment requested via the form on the website https://nexus-fidei-law.com/ does not yet constitute a binding contract.
4.1. Unless otherwise agreed, our work is carried out on a success basis. Our commission ranges between 10% and 20% of the amount actually recovered; the exact figure is set out in the engagement agreement.
4.2. There are no upfront payments, no hidden costs and no hourly rates. Without a successful recovery, no commission claim arises.
4.3. Any disbursements and third-party fees (e.g. court costs, translations) are stated separately where provided for in the engagement agreement.
5.1. The Client undertakes to provide us with all information, documents and evidence required for processing, completely and truthfully.
5.2. Incorrect or incomplete information may impair or delay processing. The Provider is not liable for disadvantages arising from such information.
6.1. We treat all information obtained during the engagement as strictly confidential.
6.2. Disclosure to third parties occurs only where necessary to fulfil the engagement or required by law. The processing of personal data is governed by our Privacy Policy at https://nexus-fidei-law.com/privacy.
7.1. We are liable without limitation for intent and gross negligence as well as for damage arising from injury to life, body or health.
7.2. In cases of slight negligence, we are liable only for breach of a material contractual obligation and limited in amount to the foreseeable, contract-typical damage.
7.3. Any further liability is excluded.
8.1. The contractual relationship may be terminated by either party in accordance with the provisions of the relevant engagement agreement.
8.2. The right to terminate for good cause remains unaffected for both parties.
9.1. If the Client is a consumer, a statutory right of withdrawal applies to distance contracts. Details are set out in the separate withdrawal instructions in the engagement agreement.
9.2. At the Client’s request, performance may begin before expiry of the withdrawal period; in that case the statutory consequences of early commencement apply.
10.1. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
10.2. For engagements handled through Nexus Fidei Legal Services Ltd, the law of England and Wales applies; the exclusive place of jurisdiction is London. For engagements handled through Nexus Fidei Legal Services GmbH, Swiss law applies; the exclusive place of jurisdiction is Zurich. Mandatory consumer protection provisions of the Client’s country of residence remain unaffected.
